Legislative background for State Pension (Non-Contributory)

The main legislative provisions relating to State Pension (Non-Contributory), previously called Old Age (Non-Contributory) Pension, are contained in:

• Chapter 4 of Part 3 of the Social Welfare (Consolidation) Act 2005 (Sections 152 to 160 inclusive) as amended; and in
• Part 3 of Schedule 3 of the above Act (as amended)
• Chapter 7 of Part III of the Social Welfare (Consolidated Payments Provisions) Regulations 1994 (S.I. No.417 of 1994) (as amended).

The Social Welfare Law Reform and Pensions Act 2006 (pdf) allows for the name Old Age Non-Contributory Pension to change to State Pension (Non-Contributory). The new name came into effect on 29 September, 2006.
